What’s next?
Decision No. 1-p(II)/2025 puts an end only to a specific case. But should it become a basis for revising legal mechanisms in the field of customs regulation? In my opinion, yes. Here are a few suggestions:
Development of a clear information system. Citizens should be aware of all restrictions before importing a vehicle.
Balance of responsibility. The legislator must create conditions under which the Ukraine at the owner will not lose the freedom to use his property, but will remain liable for violations.
Harmonization with international standards
Ukraine can take as an example the experience of EU countries, where moj data the emphasis is on fiscal mechanisms, rather than restrictions on the right of use.
The decision of the Constitutional Court of Ukraine evokes mixed feelings.
